Protecting Your Registered KuneKune Investment Why Contracts are Essential in Buying and Selling KuneKunes
By AKKPS Member Amanda Carlisle of Carlisle Acres
When purchasing or selling AKKPS Registered KuneKunes, a contract is an essential part of the transaction. Some purchasers never think to ask for a contract, not knowing to expect one. By having this simple document you can protect your Registered KuneKune Investment and ensure that all information is agreed upon by both parties.
Protects Buyers & Sellers
Why a contract? It is straightforward and protects both Buyers and Sellers in the event of a disagreement. A contract sets forth all expectations from the registration of the pig to dates of transfers and the information of both parties. If there is a dispute in registration, this contract can be presented to the AKKPS to help resolve any issues.
Proof of Registration & Purchase
A contract acts as proof of purchase and provides you with the AKKPS Registration information of the pigs you are purchasing as well as their sire and dam. The contract also provides you with vital information like wattles, AKKPS number, microchip or tag number, etc. for your records. Do not hesitate to ask for a contract before sending a deposit or any money to the seller.
Clearly Defines Information & Expectations
A contract clearly defines information and expectations. While sellers can customize their contracts in detail or have a simple version, they all define the expectations of the sale and transfer of the pig. Having a contract can remove the potential for misunderstandings between the two parties.
Enforceable By AKKPS
Contracts with both party's signatures are enforceable by the AKKPS in regards to registration. If one party does not fulfill their obligations, there is a Step Plan (click here) to help complete the registration or transfer of the pig. A copy of the contract is helpful in the step plan to remedy the situation quickly.
What to Include
If you are not interested in using the AKKPS Free Sample Contract (click here), here are some guidelines for what your contract should contain.
- Name, Address, and Contact info of both parties.
- All the information pertaining to the animal, including AKKPS number, Name, Date of Birth, Teats, Wattles, Color, etc.
- DNA Status, Registration timing, any health info, etc.
- Any money exchanged should be clearly documented on the contract.
- Any information or guidelines the seller would like to list.
- Place for both parties to sign and date.
No Contract?
If the seller does not provide a contract, the buyer can request one. The AKKPS has a FREE Sample Contract Downloadable (click here) for anyone to print and use. While it is a simple, straightforward version, it is perfect for the buying and selling of AKKPS Registered KuneKunes.
Avoid Fraud
Having a contract helps buyers avoid scammers and fraud. Please do your due diligence and check the public AKKPS Herdbook (click here) to verify the animals belong to the seller before sending any monies for deposit or sale. Do your research and make sure the breeders are listed in the AKKPS Breeders List (click here). If a seller refuses to fill out or sign a contract, it is your right not to continue with the transaction.
